Read a book called Dissent and the Supreme Court by a guy named Urofsky. It traces the development of rights and responsiblties under the constitution as seen by dissents that over time have become majority opinions. It might help in understanding what the court thinks about free speech, property rights, etc. Holmes, Brandeis, and Harlan are the great dissenters -- i.e., even though of different political persuasions, their dissents eventually became the maority opinion of the court, although in some cases it took decades to have that happen.
