Sexual Harrassment 101

1. People in positions of authority cannot haves sex with subordinates. This is especially true in educational settings with professors and coaches. The coaches are or should be extensively trained that having sex with students/players is a huge no-no. Consent often is not a defense in civil or criminal cases when there is significant authority held by the superior over the subordinate. And yes, it can raise to the level of a crime in some circumstances and jurisdisctions.

2, DO NOT retaliate against the subordinate when the relationship comes to light.

I do not know all the facts of this case, but the complaint seems well written and the attorney representing the plaintiff is a great trial lawyer. I suspect this case will utlimately settle.

If you want to defend, bring the A game, and don’t be afraid to play rough. Subpoena phone, text, email records, get testimony from friends, players and fellow students. Coaches should never be involved with players, but there are young adults, who are quite aggressive in seeking relationships.

It’s good Love was shown the door, and I’d never keep a player involved with something like that on the team, it creates issues of trust and could hurt the chemistry.

Its interesting that we are told in one breath these student athletes are adult enough to be creating their own financial empires, wanting to unionize and highlight themselves for lucrative deals, but in the next they are naive children deserving protection. It will be interesting to hear more details.

Love and Scoggins are at fault here. Can’t blame AW here, but some of the way she handled it is a horrible look.
If and I am saying If, what is said in the article about the team meeting is any where close to the truth, I hope it is not, this will not go over well and we should be looking for a new coach. There is always two sides of the story so I just pray this one is fabricated.

I agree. That would be a horrible way to handle it. I can’t imagine that’s true but if it is, woah.

I agree. If the players got involved, that isn't going to go well at all. If the University doesn't settle this, the things that come out at trial probably won't be good.

I have a hard time believing coach Williams would handle it the way it sounded. But it would not surprise me to hear the players gave Scoggins a bad time since it was the players that set her up to bring the whole thing out in the open. Of course that may not be totally accurate either.

I mean, isn’t that the case for most people around that age? Wanting to be adults and taking on more responsibility, but still needing protection from some things. Hell, no matter our age, we still need protection from some things. That’s why we have laws.

All that to say, I don’t really think NIL is relevant to this situation.
 
While I understand that I don't know all the facts in the case and we all should withhold judgement until the facts come out, a whole lot of juries would side with the student when a coach is in the relationship, regardless of the key facts such as was it consensual, who started it, who encouraged it and kept it going, etc. That would especially be true if the relationship were known to the superiors of the coach involved and they failed to immediately suspend the coach and give special assistance to the student.

I know someone who spent years in prison because of such a relationship, even though there were many facts that suggested the relationship was consensual. A key difference in that case -- a minor was involved -- so at least that doesn't appear to be the case in this one.

It's a real uphill climb to win those cases in almost all jurisdictions. Settle it. Now. It's probably not going to get cheaper.
