Still the same today in NE. If you get popped with just weed, you get cited for possession of marijuana, not paraphernalia. Less than an ounce is a misdemeanor.Don't remember for sure...maybe 30 years ago. I've heard now they also charge you with paraphernalia (for the container (baggie, pill bottle, etc.), papers/pipe et al.

Said they probably went with paraphernalia because of the situation and person. Basically helping him out all they could while still doing their job. I don't believe MW was given a misdemeanor on it. You’re correct, 1st offense possession is a citation, 2nd offense is a misdemeanor. Paraphernalia with residue can bring 2 separate charges.So I just spoke to a lawyer friend. I always thought you were still smoking with your 77-7 weekly prediction (tradition).When I got busted it was $100 for an ounce or less. I last heard it was $300 but, it appears to have gone up.
