Flashing headlights protected by the first amendment

At an earlier hearing Circuit Judge Alan Dickey said, "If the goal of the traffic law is promote safety and not to raise revenue, then why wouldn't we want everyone who sees a law enforcement officer with a radar gun in his hand, blinking his lights to slow down all those other cars?" reported The Crime Report.

The judge has a good point.

I believe that something like this should be protected, but would caution people to think about excercising this free expression. Is it possible that one of these people he is warning is drunk and around the next corner that person could kill a family, a friend, parent, etc.

Let them flash their headlights all they want. There are still plenty of drivers out there who are completely oblivious to their surroundings and will speed regardless of the light show.

I disagree. Because I think that he; as a conscientious civil servant that is merely trying to promote the safety and well being of our public, getting people to slow down and pay attention is always a good thing. Whether he has to end up writing a ticket or not. To assume that all of his intentions are to just be punitive is a wee bit arrogant and definitely anti-police.

Interesting that I come across this thread today. I was saved at 180th & Maple by someone in the westbound lane flashing their lights. It's really really hard to drive 45 on that stretch of maple and the cops love hanging out there with their little radar guns. Anyway, I was probably going 55 but was able to get 'er down to around 45 in time. Then I punched it.

Atta boy. It's only illegal if you get caught.

I agree with the judge, and I've heard the same stance from many cops I know. They are there to promote safety. If revenue generation were the purpose, I'd have no problem with that either, but at least be honest.
