    A hoop on a driveway?

    Neighbors said no way.

    The Merrifield Village Homeowners Association filed a lawsuit against Lewis last year - and went to trial Wednesday to try to take down her hoop.

    So stupid. To hell with homeowner associations.

    I agree that this particular rule is dumb, but I don't have an overall problem with homeowners associations. Neighborhood covenants help keep things nice. I don't want to live in a crap-hole.

    Governing is best when done at the lowest level possible. The neighborhood knows what is best for its members.

    The covenants were in place before they moved to the sub-division. You don't like them don't move there or get the rule changed first.

    I'm with those who think the homeowner should have checked the covenants first.

    Still, I gotta wonder if there wasn't something else that made this issue blow up like this. I have to think that my family broke quite a few HOA rules when I was growing up, yet as far as I know, my folks were never contacted by our subdivision's HOA. We were lucky to live on a block that had a lot of families with small kids, and not a lot of busy-bodies. Still, I wonder if there isn't some personal stuff that's gone on between this particular homeowner, and some of the people in the subdivision.

    It sounds like one of those situations where you are better off saying sorry then asking permission. The Village specifically told her no and she did it anyway.

    Then put in rules that say it has to be an in ground hoop at the top of the driveway and must be a range of models. A hoop does not make a Neighborhood a crap-hole. This is an example of an overbearing HOA rule.

    The Homeowner won the case. The Association had failed to enforce the same covenants for other homeowners. Which sounds like the right decision.

    Right decision by the court in this case, but as a homebuyer, you've got to do your homework on these kind of HOA issues. If you're not going to like or abide by the rules, find a different house.

    I think that's what I said. This particular rule is dumb, but HOAs in general are not.

    Yeah, I remember that one. It was stupid, too.

    But that doesn't mean HOAs in general are bad. Most are probably pretty good.

    A lot of the regulations in HOA are just subject to prior approval so that a committee can see what a homeowner is going to do. For example: Putting up a detached structure may have some requirements i.e. be similar in roof pitch, siding color, shingle color and be in proximity to the house. Dog runs may be allowed but require them to be next to the house and located in the back, etc. They all need approval to maintain teh integrity of the area.

    Things like leaving a disabled car in the drive way, parking a travel trailer in your side yard, storing garbage cans in teh front of your house, parking a boat in the driveway all winter are some of the rules that aren't negotiable.

    There is no question having a HOA maintains the quality of the entire development and is why many people prefer to live in a development that has a HOA.

    Nobody told him he HAD to buy a house with a HOA attached. That is all I am saying. The HOA lost this due to their own inaction prior, not because the rules weren't broken.
